Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and First Fruits Health and Wellness ("First Fruits", "we", "us"), the provider of the First Fruits Journey application, website, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility & account

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization. You are responsible for keeping your credentials confidential and for all activity under your account, and for keeping your information accurate.

2. The Service

First Fruits Journey is a wellness journaling application offering food logging, nutrition insights, AI-generated recipes and coaching, meal planning, and related features. The Service is provided for personal wellness use and is not medical advice, diagnosis, or treatment. Do not rely on the Service for medical decisions — consult a qualified professional.

3. Acceptable use

You agree not to:

• Use the Service for any unlawful, fraudulent, or harmful purpose.
• Send spam or infringe anyone's intellectual property or privacy rights.
• Introduce malware, probe, scan, or otherwise interfere with the Service's security or infrastructure.
• Reverse engineer, decompile, or attempt to extract source code.
• Resell, sublicense, or redistribute the Service, or circumvent usage limits.

4. Intellectual property

The Service, including all software, content, branding, and documentation, is owned by First Fruits Health and Wellness or its licensors and is protected by applicable IP laws. We grant you a limited, non-exclusive, non-transferable right to use the Service under your active plan. You retain ownership of content you submit (such as journal entries and photos) and grant us a limited license to host and process that content solely to provide the Service.

5. AI features

Some features use artificial intelligence to identify foods, estimate nutrition, and generate recipes and coaching. AI outputs may be inaccurate or incomplete. You are responsible for reviewing and using your judgment before acting on them. Do not use AI outputs as professional medical, nutritional, or clinical advice.

6. Payments

Payments are securely processed by Stripe. By subscribing, you authorize us and Stripe to charge your payment method on the recurring interval you selected until you cancel. You are responsible for keeping your payment details current. Our refund policy is available at /refund-policy. Subscriptions renew automatically at the interval you selected until canceled.

7. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may stop using the Service and delete your account at any time. On termination, your limited license ends; we may retain records as required by law and will delete or anonymize personal data as described in the Privacy Notice.

8. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that any content will be accurate.

9. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amounts you paid us in the twelve (12) months before the event giving rise to the claim. We are not liable for indirect, consequential, incidental, special, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law.

10. Indemnity

You will indemnify and hold us harmless from claims arising from your content, your use of the Service in violation of these Terms, or your unlawful conduct.

11. Changes to the Service or Terms

We may modify the Service and these Terms from time to time. Material changes will be communicated through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which First Fruits Health and Wellness is established, without regard to conflict of law rules. Courts of that jurisdiction have exclusive jurisdiction, subject to any mandatory consumer-protection rights.
